In India, any person or legal entity who claims to be the owner of a trademark can apply for its registration.
This includes:
- Individual - An individual, even without a registered business, can apply for a trademark for a name or logo intended for future use.
- Joint Owners - Partners or joint proprietors of a firm can jointly apply for a trademark under both names.
- Partnership Firm - A partnership firm (maximum 10 partners) must include the names of all partners in the application. For minor partners, the guardian’s name must be provided.
- LLP (Limited Liability Partnership) - The LLP, as a separate legal entity, must file in its own name. Partners are not considered individual applicants.
- Indian Company - A private/public limited company or any incorporated entity must register under its corporate name, not an individual director’s name.
- Foreign Company - A foreign-incorporated business must file under its original corporate name and mention its operating address in India.
- Trust or Society - Applications made on behalf of a trust or society should include the name of the managing trustee, chairman, or secretary.

Required Documents for Registration
- Business registration proof (based on type of entity).
- Identity & address proof of applicant(s).
- Proof of use (if applicable).
- "Details of the Mark" – Please specify whether the mark is a logo, word, or any other type. If submitting a logo, ensure that it does not exceed the dimensions of 8 cm x 8 cm.
- Power of Attorney (Form TM-48).
